Terms of Service

These terms (the "Terms") govern the use of software integrations built and operated by Forte Web Designs LLC, DBA Launch Forte ("Launch Forte," "we," "us"), including integrations that connect to QuickBooks Online and other third party platforms, and the use of this website. These Terms function as the end user license agreement for our integration software.

1. The service

Launch Forte builds and operates automation integrations for business clients under written engagement agreements. Each integration connects platforms the client already uses and performs the specific functions described in the client's engagement scope. Where a written engagement agreement exists between Launch Forte and a client, that agreement controls over these Terms to the extent of any conflict.

2. License

For the duration of an engagement, Launch Forte grants the client a nonexclusive, nontransferable right to use the integrations we operate on their behalf. Deliverables identified as the client's property in the engagement agreement belong to the client on payment. Underlying tooling, frameworks, and know-how used to build and operate integrations remain the property of Launch Forte.

3. Authorization and client responsibilities

Clients authorize integrations to access their third party platform accounts through those platforms' official authorization flows. The client is responsible for having the right to grant that access, for the accuracy of the data in their connected platforms, and for their own obligations to the third party platforms they use, including those platforms' terms of service.

4. Third party platforms

Our integrations depend on third party platforms and their APIs, including QuickBooks Online, which is a product of Intuit Inc. Those platforms are not provided by Launch Forte, and we are not responsible for their availability, their pricing, or changes they make to their services or APIs. Use of any third party platform remains subject to that platform's own terms and privacy policy.

5. Data

Data handling is described in our Privacy Policy at launchforte.com/privacy. In short: client data accessed by an integration is used only to operate that integration, is not sold, and access can be revoked by the client at any time.

Text messaging terms: the Radiant demo program

By entering your mobile number and checking the consent box at launchforte.com/demo/medspa, you agree to receive one demonstration sequence of up to three text messages, each prefixed [Radiant demo]. Message frequency: up to three messages per opt in, limited to one demo sequence per phone number per 24 hours. Message and data rates may apply. Reply STOP at any time to cancel. Reply HELP, or email seth@launchforte.com, for help. Carriers are not liable for delayed or undelivered messages. See the privacy policy at /privacy for how phone numbers are handled.

6. Disconnection and termination

A client may disconnect an integration at any time by revoking its access inside the connected platform or by written request to us. Either party may end an engagement per the engagement agreement. On termination, the integration's access to the client's platforms is revoked and any data retention follows the Privacy Policy.

7. Disclaimer of warranties

Integrations are provided as described in the applicable engagement agreement. Except as stated there, the service is provided "as is" and we disclaim implied warranties to the fullest extent permitted by law. We do not warrant uninterrupted operation of third party platforms or APIs.

8. Limitation of liability

To the fullest extent permitted by law, Launch Forte's total liability arising out of the service is limited to the amounts paid by the client for the engagement giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules.

10. Changes

If these Terms change, the updated version will be posted at this page with a new effective date.
